Terms of Service

Eligibility

You must be at least 18 years old to create an account and use ListMe. If you are under 18, you may only use the Service with parental consent and supervision. By creating an account, you represent that you meet these age requirements.

Account Types

• Regular Users: Full account with email/password authentication
• Guest Users: Temporary accounts for event attendance without full registration
• Organizer Accounts: Enhanced accounts for event creation and management
• Venue Accounts: Specialized accounts for venue owners and managers

Account Security

You are responsible for safeguarding your login credentials and maintaining the security of your account. You agree not to share your account with others and to notify us immediately of any unauthorized access or security breaches.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose risks to other users or the platform.

Event Creation

Event organizers are responsible for providing accurate event information, including dates, times, locations, capacity limits, and event descriptions. You warrant that you have the necessary permissions and licenses to host events at specified venues.

Event Compliance

Organizers must ensure their events comply with all applicable laws, regulations, safety requirements, and venue policies. This includes but is not limited to capacity limits, age restrictions, health regulations, and licensing requirements.

Guest Management

Organizers are responsible for managing their guest lists, RSVPs, and check-ins. Any disputes regarding event attendance or access should be resolved directly between organizers and attendees.

Event Cancellation

If you need to cancel an event, you must notify attendees through the platform as soon as possible. Refund policies for paid events are determined by the organizer and should be clearly communicated to attendees.

Content Ownership

You retain ownership of content you submit to the platform, including event descriptions, images, and other materials. By uploading content, you grant us a license to use, display, and distribute this content for platform operations.

Prohibited Content and Activities

You agree not to post content or create events that:

• Violate any laws or regulations
• Promote illegal activities, discrimination, or hate speech
• Infringe on intellectual property rights
• Contain explicit sexual content or nudity
• Promote violence, harassment, or harmful behavior
• Involve fraudulent or deceptive practices
• Spam or unsolicited promotional content
• Violate privacy rights of others
• Events without proper permits or authorizations

Event Content Standards

All events must be legitimate gatherings with clear purposes. We prohibit events that exist solely for the purpose of data collection, harassment, or other non-genuine social purposes.

Payment Processing

Payments for events and subscriptions are processed through Stripe. By using payment features, you agree to Stripe's terms of service and privacy policy. We do not store payment card information on our servers.

Platform Fees

ListMe may charge platform fees for certain services, including event ticketing and premium features. All fees will be clearly disclosed before transactions.

Subscriptions

Subscription fees are billed according to your chosen plan (monthly or annually). Subscriptions automatically renew unless cancelled before the renewal date. We provide at least 30 days notice for subscription price changes.

Refunds

Platform subscription refunds are handled on a case-by-case basis. Event ticket refunds are governed by individual event organizer policies. Contact our support team for refund requests.

Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your personal information.

Data Sharing

When you RSVP to events, certain information (name, profile details) may be shared with event organizers for guest list management. You can control your privacy settings in your account preferences.

Analytics and Insights

We provide event organizers with anonymized analytics about their events. Individual user behavior is aggregated and anonymized for these insights.

App Store Terms

Our mobile applications are distributed through app stores (Apple App Store, Google Play Store). Additional terms from these platforms may apply to your use of our mobile apps.

Device Permissions

Our mobile apps may request device permissions (camera for QR scanning, location for venue finding, notifications for event updates). You can manage these permissions through your device settings.

Offline Functionality

Some app features may work offline (ticket display, event details). However, most features require an internet connection for full functionality.

Platform Rights

ListMe, our logos, trademarks, and platform design are proprietary to ListMe Inc. You may not use our intellectual property without written permission.

User Content Rights

You retain rights to content you create and upload. However, you grant us necessary licenses to operate the platform, including displaying your content to other users and in search results.

Copyright Infringement

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, contact us with a detailed notice including proof of ownership.

External Services

ListMe integrates with third-party services including Stripe (payments), email providers, mapping services, and social media platforms. These services have their own terms and privacy policies.

Third-Party Content

We are not responsible for content, accuracy, or availability of third-party services integrated with our platform. Use of these services is at your own risk.

API Usage

If you use our APIs, additional terms may apply. API access is provided for legitimate integration purposes and must not be abused or used to overload our systems.

Termination by You

You may terminate your account at any time through your account settings or by contacting support. Upon termination, you remain responsible for any outstanding obligations.

Termination by Us

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose risks to the platform or other users. We will provide notice when possible, except in cases of severe violations.

Effect of Termination

Upon termination, your access to the Service will cease. We may retain certain information as required by law or for legitimate business purposes. Event data may be preserved for historical and analytical purposes.

Informal Resolution

Before filing any legal claim, you agree to first contact us to seek informal resolution of the dispute. We encourage direct communication to resolve issues quickly and amicably.

Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

Class Action Waiver

You agree that any disputes will be resolved individually and not as part of a class action, collective action, or representative proceeding.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Unenforceable provisions will be modified to achieve their intended purpose to the greatest extent possible.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and ListMe regarding your use of the Service.

Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
